Review | BRPTO’s Strategic Plan for 2023-2026
At the beginning of 2023, the Brazilian Patent and Trademark Office (BRPTO) published its Strategic Plan for the 2023-2026 period, as well as its 2022 Management Report. Both documents highlight BRPTO’s commitment to progress.
The goals until 2026 include reducing the patent examination backlog from 6.9 years (counted from the filing date) to 2 years. For industrial designs, the goal established was to reduce the period of technical examination decisions from 3.7 months to 3.5 months.
Meanwhile, for trademarks, the objective is, for applications without opposition, to go from the current 10 months (counting from the filing) to 1 month until 2026 and, for applications with opposition, from the current 16 months (counting from the publication of the application – after 1st examination) to 7 months in 2026.
Moreover, nine strategic goals were set forth to ensure BRPTO’s progress, namely:
- Optimize quality and agility in the granting and registration of industrial property rights, achieving international performance standards;
- Promote culture and the strategic use of industrial property to provide the country with competitiveness and innovation;
- Consolidate Brazil’s insertion as a protagonist in the international industrial property system;
- Increasing knowledge and recognition of BRPTO’s value to society;
- Deepen digital transformation with a focus on improving performance and service to users;
- Ensure sustainable financing for modernization and expansion of service provision capacity;
- Ensure the reconstitution and retention of a workforce to meet increasing demand and maintain high performance in service provision;
- Provide economic, efficient, and sustainable logistics and infrastructure support;
- Improve governance and management practices, and institutional relationships.
The 2022 Management Report disclosed points such as the following:
- Origin of the majority of patent applicants in Brazil – United States (28.6%), Brazil (24.8%) and China (6.0%) are first to third, respectively;
- Profiles of the groups of patent applicants in Brazil – Individuals (43.4%) and legal entities (22.5%) hold the top 2 positions;
- As disclosed, 27,139 patent applications were filed in 2022;
- Nearly 400,000 trademark applications were filed in 2022;
- 7,196 industrial design applications were filed in 2022;
- Establishment of goals to improve efficiency in examining IP applications.
