Brazil — INPI 2025 updates: patents (grant-fee waiver and automation) and trademarks (first-decade/registration waiver)

Brazil’s National Institute of Industrial Property (INPI) has implemented a new Schedule of Fees and staged automation of post-grant steps. Most new values took effect on August 7, 2025. Selected automation milestones apply on September 20, 2025 (trademarks) and December 20, 2025 (patents).

Patents — what changes and when

Automated, zero-fee issuance of Letters Patent.

As from December 20, 2025, INPI will issue Letters Patent without charging the former issuance fee (service codes 212/213). There will no longer be definitive shelving for non-payment of these services.

Transition for allowances before December 20.

For cases with allowance published from RPI 2855 (September 23, 2025) onward, applicants may either (i) pay by December 19, 2025 to accelerate issuance before December 20, or (ii) wait for the automatic issuance at zero official fee as from December 20, 2025. Allowances published before RPI 2855 remain subject to payment under the prior rule. Refunds are not available for fees paid before the zero-fee date.

Trademarks — what changes and when

Automated, zero-fee first decade and certificate.

As from September 20, 2025, INPI will automatically issue the first ten-year term and the registration certificate without charging the former post-allowance fees (services 372/373 and, for Madrid, 3012).

What right-holders should do now

Patents

• Portfolio check: identify applications nearing allowance. For those allowed from RPI 2855 (September 23, 2025) onward, decide between optional payment by December 19, 2025 to accelerate issuance, or automatic issuance from December 20, 2025 at zero official fee.
• Calendar the milestones: December 20, 2025 for automated patent issuance; ensure internal and outside counsel workflows reflect the transition.

Trademarks

• Pipeline triage: for allowances published from RPI 2842 (June 24, 2025) onward, consider whether to (i) pay by September 19, 2025 to obtain the certificate before the switch-over, or (ii) allow the case to be automatically issued after the window closes or after September 22, 2025.
• Budget refresh: incorporate the new Schedule of Fees effective August 7, 2025 for filings and other services going forward.
