Brazil decriminalizes the possession of cannabis in small quantities for personal use.
Brazil, along with many other countries, is currently debating the use of cannabis-derived products. The Brazilian Supreme Court (STF) decided on June 25, 2024 to decriminalize the possession of cannabis for personal use in specific situations (40g or six female plants). With the relaxation of legislation on the matter over the last few years, many companies are showing interest in this new Brazilian market.
From a search carried out in the The Brazilian Patent and Trademark Office database, it is possible to observe a growing curve – more than 200 patent applications containing the terms cannabis or cannabidiol or CBD were filed after the Brazilian Health Regulatory Agency (ANVISA) published regulations regarding the import and sale of cannabis-based medicines (2014) – more than 50% were recently filed, after 2020. Granted cases include therapeutic uses, new processes for the synthesis / extraction of cannabidiol, extracts, and smoking devices.
In this environment of legislative change, it is important to develop and update strategies for a successful patent portfolio.
