INPI updates procedures regarding transfers of ownership and changes of name, address for patent applications.
Ordinance INPI/DIRPA No. 20, of September 13, 2024
On September 17, 2024, the Brazilian National Institute of Industrial Property (INPI) published a new ordinance outlining procedures for transfers of ownership, changes of names or company names, addresses, headquarters, and annotations of limitations or encumbrances for patent holders, as specified in the Industrial Property Law (LPI).
See below the main changes regarding the documents attached to the petition.
Art. 18: Documents attached to applications may be digitally signed with certificates issued by ICP-Brasil.Other means of digital certification that may be considered in a specific Ordinance from INPI on the subject may also be accepted.
Art. 19: Foreign-origin documents submitted with applications must have notarization and consular legalization.
- 1º Consular legalization may be replaced by an Apostille according to the Hague Convention.
- 2º Foreign-origin documents digitally signed are exempt from notarization, consular legalization, or Apostille, provided that Article 18 has been observed.
Art. 20: Any document in a foreign language must be accompanied by its corresponding free translation.
