PPH programme to start in 2025 in Brazil
On December 10, 2024 the INPI published a new ordinance directed to PPH applications in Brazil, which will be acceptable as from January 1st, 2025.
The main differences established by Ordinance No. 48 compared to previous rules are as follows:
– New application limits have been set: up to 3,200 applications can be received per annual cycle and up to 1,000 applications can be made in the same Section of the International Patent Classification.
– There is no limit of PPH requests by applicants per week
– The INPI will now accept PPH applications that are not prioritised by an IP Partner Office.
– The definition of “Patent Family” has been excluded.
– Partner offices included those that are participants in the GPPH.
– The INPI will accept the result of the technical examination that contains patentable subject matter from INPI Partner Offices.
– The concept of “Subject Matter Considered Patentable” has been amended to include examined subject matter by the PCT.
– The concepts of “Corresponding Patent Application”, “Sufficiently Corresponding Claim” and “More Restricted Claim” have been inserted.
– The quantitative restriction on the number of applications for participation using the results of the PCT was excluded.
