Tradition and Origin: Understanding Geographical Indications

Geographical Indications (GI) recognize products or services in which quality and characteristics are directly related to their geographical origin. GIs value the reputation, tradition, and know-how associated with the production location.

In Brazil, the Industrial Property Law (LPI) classifies GIs into two categories: Indication of Origin (IP) and Denomination of Origin (DO).

CATEGORIES

The Indication of Origin (Art. 177) refers to the name of a place that has distinguished itself as a center for the extraction, production, or manufacturing of a specific product or service.

The Denomination of Origin (Art. 178) designates a location whose qualities or characteristics of the product or service are directly related to the geographical environment, including natural and human factors.

INTERNATIONAL

Some examples of famous international GIs registered in Brazil include:

•Champagne: Sparkling wine produced in a specific region of France.
• Tequila: Distilled spirit made from agave tequilana Weber, blue variety, from the Tequila region in Mexico.
• Port Wine: Fortified wine originating from the Porto region in Portugal.
• Roquefort: Famous French cheese with protected designation of origin.

IN BRAZIL

The number of Brazilian GIs has grown significantly. This recognition benefits and strengthens regions and local producers who can apply for the registration of their products with the INPI.

According to the update from September 10, 2024, published by the INPI, Brazil has 129 recognized Geographical Indications, consisting of 91 Indications of Origin (all national) and 38 Denominations of Origin (28 national and 10 international).
